*385GIVENS, Justice.

Plaintiff sued Wesco Builders, Inc., for breach of a building contract, and respondent Bank and appellants for certain subsequent, but connected transactions injurious to her title.

Wassler, an individual, and Murray Burns Plumbing Co., a partnership, answered denying any nefarious complicity and cross-complained respectively against the Bank. The Bank demurred to plaintiff’s complaint and the cross complaints, and moved to strike the material allegations thereof. The Bank’s demurrer to plaintiff’s amended complaint is not in the record, but the court in its judgment sustained…
