MELTON, District Judge.

This cause is before the Court on the following motions: plaintiffs’ motion for partial summary judgment; defendants’ motion for partial summary judgment; and defendants’ motion to refer its Shipping Act defense to the Federal Maritime Commission. All three of these motions were filed on May 30,1986, and timely responses have been filed as to each. Additionally, on August 6, 1986, plaintiffs filed a supplemental memorandum to their motion for partial summary judgment on the issue of collateral estoppel and defendants filed a response thereto on August 7,1986.
