This suit arising out of an automobile accident is brought under the survival act (3 Comp. Laws 1929, § 14040) for the recovery of damages incident to the death of Allen Collar, a 13-year old boy. On trial before the court without a jury plaintiff had judgment from which defendants have appealed.
