The procedural history of this matter is relevant. On October 11, 1994, plaintiffs filed a 12 count complaint against defendants, Baugher Insurance Agency (Count nos. I, II, III, XII), Yorktowne Mutual Insurance Company (Count nos. IV, V, VI, VII, VIII), and Pennsylvania National Insurance Companies (Count nos. IX, X, XI).
