FRIENDLY, Circuit Judge.

Davis & Randall, Inc. (hereafter D & R), a New York corporation with its principal place of business in the Western District, is engaged in the interstate transportation of a few types of commodities in truckload lots. It filed with the Interstate Commerce Commission schedules, to become effective on January 21, 1960, for reduced truckload rates on malt beverages, minimum 38,000 pounds, from Newark, N. J. to certain Ohio, Indiana and Illinois points. Typical proposed rates, all stated per hundred pounds, were 700 for a 589-mile haul to Dayton as against the existing…
