This is a common law action by Edwin Arthur Dyer against United East & West Oil Company, a corporation, for recovery of damages for personal injuries sustained by him as the result of a gas explosion in a lease house on one of the company’s leases. While it is a common law action the common law defenses of contributory negligence, assumption of risk and negligence of a fellow-servant are not available to the company, since it was eligible as a subscriber under the Workmen’s Compensation Law, but failed to subscribe.…
