LESLIE, Chief Justice.
Addison Hester, a planer feeder, instituted this suit for personal injuries against A. M. Callahan, a sawmill operator eligible to be a subscriber to the Workmen’s Compensation Law, Article 8306 et seq., Vernon’s Ann.Civ.St., but a nonsub- scriber thereto. He alleged such injuries to his hand, arm and other parts of his body were proximately caused by the negligence of Callahan in allowing the floor to be slick about the planer and failing to protect the pulleys, belts, cog wheels and apron of said planer.
