On April 24, 2010, Melissa Myers (“Myers” or “plaintiff’), through attorney Angela O. Martin (“Martin”), filed this action alleging violations of the Fair Debt Collection Practices Act (“FDCPA”) [D.E. 1], Myers alleged that defendants failed to notify the Cumberland County Clerk of Court that partial payments had been made to defendants as a judgment creditor, and that such failure violated North Carolina law and the FDCPA.
