MEMORANDUM OPINION
MICHAEL F. URBANSKI, District Judge.
This matter is before the court on defendant Ford Motor Company’s (“Ford”) Motion to Dismiss for Failure to State a Claim (Dkt. No. 5). Ford seeks, pursuant to Federal Rule of Civil Procedure 12(b)(6), dismissal of Count II in so far as it is based on a breach of express warranty,1 Count IV (punitive damages), and Count V (violation of the Virginia Consumer Protection Act).
