MEMORANDUM OPINION AND ORDER GRANTING IN PART, AND DENYING IN PART, BENEFICIAL MORTGAGE COMPANY OF KANSAS, INC.’S MOTION FOR SUMMARY JUDGMENT

This adversary proceeding is before the Court on Defendant’s Motion for Summary Judgment. 1 It is related to the Plaintiffs’ bankruptcy proceeding and all parties have consented to the trial and entry of a final order by the Bankruptcy Court. 2 Therefore, the Court has jurisdiction to hear this matter. 3 For the reasons stated below, the Court grants the Defendant’s motion, in part, and denies it in part.
