This action was brought in the district court of Kiowa county, on an indictment found on October 9, 1902, jointly against the plaintiff in error, Bennett Hurst, and J. J. Hurst, charging them with the offense of larceny of a domestic animal, under section 561 of the crime act. The animal alleged to have been stolen is described in the indictment as one brown two year old steer, branded on the hip, the personal property of Thomas Waggoner.
