FACTUAL BACKGROUND
This litigation arose out of a uranium mill tailings remediation project in Slick Rock, Colorado. In April 1983, the United States Department of Energy (DOE) contracted with MK-Ferguson (MK-F) to clean up several uranium mill tailing sites throughout the United States, including Slick Rock (the “Contract”).
