TORBERT, Chief Justice.

In this case the trial court granted summary judgment in favor of the Mead Corporation and against Appellant/Plaintiff, an injured employee of an independent contractor.

*460The facts of this case are as follows:

On April 19, 1973, the Mead Corporation (Mead) and Daniel Construction Company (Daniel) entered into a letter agreement whereby Daniel agreed to construct a mill for Mead.
