Raul A. Martinez, Jr., appeals his conviction for capital murder.1 Because the state chose not to seek the death penalty, the jury’s finding of guilt resulted in a sentence of life in prison. The Thirteenth Court of Appeals upheld his conviction.2 Martinez v. State, 204 S.W.3d 914 (Tex.App.-Corpus Christi 2006).
