In Re Project Cost & Special Assessment Roll for Chappel Dam

Petitioners appeal as of right an order of the circuit court granting respondents’ motion to affirm respondents’ special assessment roll and dismissing petitioners’ appeal of the special assessment roll. We affirm.

I. FACTS

Chappel Dam is located on Wiggins Lake in Sage Township, Gladwin County. As far back as 2001, the Department of Environmental Quality communicated with the Gladwin County Drain Commissioner, Sherry Augustine, that Chappel Dam required substantial repair and was a public health hazard.
