Under consideration are Defendants’ Motion to Compel Discovery (doc. 57) and Defendants’ Motion to Compel and for Sanctions (doc. 73).

A. The Duty to Confer

Before presenting a discovery dispute to the Court for resolution, the parties are required by both local and federal rule to certify they have “in good faith conferred or attempted to confer with the person or party failing to make the discovery in an effort to secure the information or material without court action.” See Fed.R.Civ.P. 37(a)(2)(B); D.Kan.
