The Court has before it a motion for summary judgment under Rule 56(c) of the Federal Rules of Civil Procedure, made applicable to these proceedings by Federal Rule of Bankruptcy Procedure 7056, filed by Peerless Insurance (“Plaintiff’) against the Debt- or/Defendant Donna Sherrell Swanson (“Defendant”). Plaintiff seeks an order excepting from discharge a $65,000 debt owed by the Defendant to the Plaintiff pursuant to section 523(a)(2), (a)(4) and (a)(6) of the Bankruptcy Code.
