This action was brought in the first instance against the city of Stillwater and the Minneapolis & St. Paul Suburban Railroad Company to recover damages for personal injuries. Before the trial the action was dismissed as to the city and a proceeding commenced against it under the workmen’s compensation act. The industrial commission held that appellant was not an employe of the city and denied compensation.
