THE COURT.

Plaintiff, as the named beneficiary, brought this action to recover on a life insurance policy issued by defendant on the life of her husband, Noah Hen-ricks.

The basic facts are not in dispute, having been stipulated to by the parties, and are as follows:

On May 19, 1924, the defendant issued a policy of life insurance upon the life of Noah Henricks, a California resident, in the sum of $2,500.
