MEMORANDUM OPINION
FARNAN, District Judge.
Presently before the Court is a Motion To Dismiss filed by Defendant Barr Laboratories, Inc. (“Barr”). (D.I.18). For the reasons discussed, the motion will be granted.
PROCEDURAL HISTORY
In June 2001, Barr filed an Abbreviated New Drug Application (“ANDA”), pursuant to 21 U.S.C. § 355(j)(2), seeking approval from the Food and Drug Administration (“FDA”) to market alendronate sodium tablets, 70 mg, a generic equivalent of Merck & Co.
