This is a suit by a depositor against the officers and. directors of the defunct Bank of Commerce, to hold them individually liable for the loss of a deposit claimed to have been made at a time when the bank was insolvent. There was a verdict and judgment in favor of the' defendants. The plaintiff appealed, and has assigned errors. The declaration contains four counts. There was a demurrer to the second and third counts, which was sustained by the Circuit Judge, and this is assigned as error.
