This is the second time that a final entry in the court below has been before this court in this case.

On the first trial of this cause in the Court of Com mon Pleas, the court directed a general verdict in favor of the railway company. Thereupon plaintiff filed a motion for new trial, which was sustained. The judgment granting a new trial was affirmed by this court and the Supreme Court overruled a motion to certify.

In the second trial a general verdict was returned in favor of the plaintiff. The company filed motions for a judgment non obstante veredicto on the special findings of the jury…
