This is an action to recover damages, originally brought in the insolvency court of Hamilton county by a property owner against the city of St. Bernard, to recover damages caused by the adoption of a grade of the street in front of her property, which is alleged to be an unreasonable grade. The action of the city establishing the grade occurred on March 13, 1914. Mrs. Gohman and her predecessors in title had owned the real estate many years prior to that date, and had erected improvements thereon prior to the adoption of any grade by the municipality, and in so doing attempted to anticipate a…
