This is an appeal by the defendant Kel-hen Corporation from a judgment by the Superior Court awarding the plaintiff MBT Construction Corp. the sum of $4,617.87 in an action involving a contract executed by the parties. 1

Henry Bigger, president of defendant corporation, and Brian Gillson, vice president and general manager of plaintiff corporation, began discussions in May 1976 concerning a restaurant defendant wished to have constructed in a building on Thames Street in Newport.
