This matter comes before the Court on defendants’ Motion to Dismiss and Plaintiffs’ Motion to Maintain a Class Action. Hearings were held at which all parties appeared through counsel. For the reasons set forth below, the Court denies the Defendant Armour and Company’s Motion to Dismiss for failure to state a claim, sustains Defendant Armour Food Company’s Motion to Dismiss for failure to state a claim, denies the defendants’ motion to dismiss related to improper venue and sustains plaintiffs’ Motion to Maintain a class action.
