MEMORANDUM RE CLASS ACTION ISSUES

URBOM, District Judge.

The named plaintiffs, Richard H. Ralston, Nancy Jeanne Ralston, and Patrick D. McAnany, have alleged violations by the defendants of Section 1 of the Sherman Act, 15 U.S.C. § 1. Specifically, the third amended complaint alleges that the multiple corporate defendants, consisting of the manufacturer, the importer, a regional distributor, and dealers of new Volkswagen automobiles, entered into a conspiracy to maintain the price of new Volkswagen vehicles at an artificially inflated level by agreements to eliminate price competition whereby…
