HURD, United States Magistrate Judge.

I. INTRODUCTION

Presently before this court is plaintiffs application for attorney’s fees and expenses. The defendants have moved for travel costs in the appearance of defendant Terry Gowett (“Gowett”), and for sanctions.

This action involves claims for violation of plaintiffs constitutional rights pursuant to 42 U.S.C. § 1983. The case was tried before this court and a jury on September 6, 7, 8, 9, and 12,1994, in Utica, New York.
