This is a plea of privilege case to determine the proper venue of a suit alleged to be for the partition of personal property, and involves the construction of Subdivision 13 of Article 1995, Vernon’s Annotated Civil Statutes. The property involved is a truck line, alleged to be part of the estate of J. H. Gilbert, deceased, which is being used by one of his sons, Roy J. Gilbert.
