MEMORANDUM OPINION

This matter is before the Court on Defendant’s Motion to Dismiss. For the following reasons, this Motion will be granted in part and denied in part.
I. Background
This case arises out of a contractual agreement between Plaintiff Corinthian Mortgage Corporation, doing business as SouthBanc Mortgage (“SouthBanc”) and its mailing list broker, Defendant Choice-Point Precision Marketing, LLC (“Choice-Point”).
