OPINION AND ORDER

RUDY LOZANO, District Judge.

This matter is before the Court on: (1) Plaintiffs Motion for Partial Summary Judgment, filed on November 18, 2010; and (2) Defendant’s Motion for Summary Judgment, filed on December 16, 2010. For the reasons set forth below Plaintiffs Motion for Partial Summary Judgment is DENIED and Defendant’s Motion for Summary Judgment is GRANTED. This case is DISMISSED and the Clerk is ORDERED to enter judgment in favor of Defendant and close this case. BACKGROUND
