The complaint alleges that the defendant is a physician and surgeon duly licensed to practice in the State of New York; that on or about the 12th day of February, 1921, the plaintiff, who at that time was suffering from a malady known as duodenal ulcer, entered into an agreement with the defendant wherein and whereby and for and in consideration of the sum of $150, to be paid by the plaintiff to the defendant, the defendant agreed to perform a surgical operation on the plaintiff for the removal of the duodenal ulcer from the plaintiff’s body.
