It is the second appeal. The first appeal is reported, Dyer Bros. I. Wks. v. Central I.Wks., 182 Cal. 588 [189 P. 445]. After the decision on the first appeal the case was remanded to the trial court and, pursuant to the mandate of the supreme court, the demurrer was overruled, the defendants answered, and a trial was had before the court sitting without a jury.
