Error from Garfield County Courtj James B. Cullison, Judge. Action by Albert Stephenson against Peter Oligschlager. Judgment for plaintiff, and defendant brings error.

This was an action based upon a contract entered into between the defendant in error, plaintiff below, and the plaintiff in error, defendant below, by the terms of which the plaintiff was to perform certain labor for the defendant, for which services the defendant agreed to pay him the sum of $25. The cause was tried to a jury in the county court of Garfield county, and, after the evidence was all in, the court gave the following instruction :
“Gentlemen of the jury, you are instructed that under the Constitution uf the state of Oklahoma six men constitute a legal jurjr in the county court;…
