—In an action, inter alia, to impose a constructive trust, the plaintiffs appeal from a judgment of the Supreme Court, Queens County (Lisa, J.), entered April 22, 1998, which, upon an order of the same court dated March 13, 1998, confirming the findings of fact and conclusions of law set forth in the decision of a Referee to hear and report (Leviss, J.H.O.), dated October 16, 1997, in effect, dismissed the complaint.

Ordered that the judgment is affirmed, with costs.
