This case is before the Court on the motion of the defendant, Chemical Construction Corporation (“Chemico”), to compel the plaintiff, Stamicarbon, N.V. (“Stamicarbon”), pursuant to Rule 37(a), F.R.Civ.P., to answer interrogatories and to produce all documents identified by Stamicarbon in its answers to the interrogatories. Stamicarbon has refused the discovery on the ground that the information sought pertains to issues which may not be raised in this action.
