MEMORANDUM OPINION

I. INTRODUCTION

Daniel Siebert (“the Petitioner”), an Alabama inmate under sentence of death, filed a petition in this court for writ of habeas corpus under 28 U.S.C. § 2254. The State of Alabama (“State”) has filed a Motion to Dismiss (Doc. # 8), asserting that the Petitioner has failed to petition the court within the one year statute of limitations for habeas petitions established in 28 U.S.C. § 2244(d), part of the Antiterrorism and Effective Death Penalty Act (“AEDPA”).
