Respondent Hub Plastics, Inc. (“Company”) refused to bargain with the International Brotherhood of Electrical Workers, Local 2020, AFL-CIO-CLE (“Union”), even though the National Labor Relations Board (“NLRB” or “Board”) had certified the election results making the Union the exclusive representative of an appropriate unit of the Company’s employees. The Union then charged the Company with unfair labor practices under §§ 8(a)(1) and 8(a)(5) of the National Labor Relations Act, 29 U.S.C. § 158 (“NLRA”).
