This is an appeal from a judgment of the district court denying an injunction.
The Twin Falls Canal Co. is seeking to issue bonds against the property of the company consisting of its irrigation system, water appropriation and franchises, for the sum of $300,000, and to execute a mortgage on the system to secure the payment thereof. Th& appellant Hobbs is a stockholder in the respondent company and a settler under this canal system on land to which a water right is appurtenant and which water right is represented by the stock appellant owns in the corporation.
