James R. Fairchild sued his former employer, Forma Scientific, Inc. (“Forma”) alleging that Forma fired him because of his age and disability in violation of the Age Discrimination in Employment Act (“ADEA”), 29 U.S.C. § 621 et seq., and the Americans With Disabilities Act (“ADA”), 42 U.S.C. § 12101 et seq. Fan-child also alleged that Forma denied him disability benefits in violation of the Employee Retirement In come Security Act (“ERISA”), 29 U.S.C. § 1101 et seq.
