Plaintiff instituted suit in the district court to recover certain real property. 1-Ie alleged that he was a full-blood Creek Indian. That his mother, Sarah Deere, died intestate in possession of the land in controversy and that plaintiff inherited an undivided one-half interest in said tract of land. That a guardian was appointed for this plaintiff April 12, 1912, at which time said plaintiff was a minor of more than 14 years of age, and that, under the law he had the right to nominate his own guardian.
