This was an action by the defendant in error to recover certain taxes which had been paid under protest, the taxes in question having been levied! for the purpose of creating a sinking fund and paying the interest on certain outstanding school district bonds amounting to $13,500. and alleged to have been issued in excess of the limitations imposed by the Constitution and by statute against incurring indebtedness.
