The parties appear here as they appeared in the trial court, and they will be referred to as plaintiff and defendant, respectively.

The plaintiff filed a petition in the district court of Creek county against tlie defendant and alleged, among other things, that $259,000 in funding bonds theretofore issued by the city of Sapulpa and repurchased by it with a portion of its sinking fund werej void. The prayer was that the city of Sa-pulpa be perpetually enjoined from selling or in any wise disposing of the bonds.
