MEMORANDUM AND ORDER

BELOT, District Judge.

This case comes before the court on defendant’s motion to dismiss for lack of subject matter jurisdiction and to compel arbitration. (Doc. 3) The matter has been fully briefed and is ripe for decision. (Docs. 4, 10, 11.) Defendant’s motion is DENIED for reasons set forth herein.

I. INTRODUCTION 1

Plaintiff was employed by defendant in Wichita, Kansas. At all relevant times, plaintiff was also a member of the National Guard. In October, 2003, while employed by defendant, plaintiff received notice that she was being called to active duty to serve in Iraq.…
