INTRODUCTION

The plaintiffs, Rose Loltek-Jick and Todd Jick (the “Jicks") had previously brought an action against an interior designer, James Swan and James Swan and Co., Inc. (collectively, “Swan”), in the Suffolk Superior Court, as a result of work that Swan was performing for the Jicks in connection with the construction of their home in Chestnut Hill, Massachusetts (the “Swan litigation”).
