BERRY, Justice.

This litigation resulted from a highway mishap occurring to a motorist near a railway crossing. The material facts are not in dispute. Midland Valley Railroad Com pany, a corporation, operates between Stig-ler, Oklahoma, and Fort Smith, Arkansas, a single-track line which, at a point approximately two miles west of Keota, Oklahoma, stretches from the northwest towards southeast and intersects with State Highway # 9 at a fairly sharp angle.
