Leslie M. Taylor was indicted for murder in the second degree by the Franklin County Grand Jury at the September 1955 term. The indictment, in addition to other allegations, charged that on or about September 13, 1955, within said county, Taylor “did purposely and maliciously kill Lewis M. Lupo.” Taylor entered a plea of not guilty and the case was tried to a jury. Taylor was found not guilty of murder in the second degree, but guilty of manslaughter. A motion for a new trial was filed and overruled by the trial court, after which Taylor was sentenced to the Ohio Penitentiary.
