The defendant was indicted for the crime of murder in the second degree. It was the claim of the State that the defendant, Jimmie Carter, purposely killed Dorothy Carroll.

The defendant, with his wife and two other persons, had been drinking together during the evening of December 26th. About 1:00 o’clock A. M. of the 27th they all went in search of more liquor. When they arrived at a cafe on Scovill Avenue a quarrel developed between the defendant and his wife, and Dorothy Carroll who was a close friend of Mrs. Carter became involved in the argument, and a fist fight…
