Appellant contracted tlie occupational disease of silicosis while employed at appellee’s silica mine, and he broug’ht this suit to recover damages on that account. At the conclusion of the plaintiff’s testimony the court directed the jury to return a verdict in favor of the defendant, which was done, and this appeal is from the judgment rendered on that verdict.
