Appellee brought this action for a balance of salary as sheriff of appellant county. He was elected and served the county as sheriff-for two terms. His first term began with the admission of Arizona into statehood, February 14, 1912, and extended to December 31, 1914. His second term was the years 1915 and 1916. When he took office February 14, 1912, there was no compensation attached to it. It was essentially a fee office under the territorial laws, and. as the fee system of compensating public officers was abolished by the Constitution (section 17, article 22), he was inducted into office…
