Plaintiffs instituted this action to recover an amount of money they were compelled to pay over and above the contract price of a dwelling house.
Plaintiffs alleged that they were induced by false representations of defendant to enter into a contract to build a home for themselves at a cost of $3,700; that defendant described to plaintiffs a so-called Pabco construction plan under which plaintiffs’ home could be built, and represented to plaintiffs that, under that plan, which would be employed in connection therewith, defendant would control and supervise the construction of the home.
